1. Acceptance. By using pharm-tec.com, you agree to be bound by and to comply with this Terms of Use Agreement. Pharm-Tec reserves the right to change these terms from time to time, as it deems to be necessary. We will always post notice of those changes, and the date that they become effective, within the current Terms of Use Agreement on the Web site.

2. Scope. The terms of use set forth in this agreement apply only to your use of pharm-tec.com. Pharm-Tec., Inc., operates other Web sites that are covered by their own conditions as specified within those Web sites.

Pharm-Tec, Inc., makes no express or implied warranty regarding the accuracy, content, completeness, reliability, operability, or legality of information contained within this web site, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights.

5. Consequences. Pharm-Tec reserves the right to suspend or terminate your account if you violate the Terms of Use Agreement. If your violation causes harm to others, you agree to indemnify and hold Pharm-Tec harmless from and against any and all loss, damage, or expense. If any dispute arises between us regarding this Agreement or your use of pharm-tec.com, it shall be resolved through good faith negotiations between the parties. If such efforts prove unsuccessful, all such controversies, claims, or disputes shall be submitted to binding arbitration pursuant to the Federal Arbitration Act, 9 U.S.C., §1 et seq. Arbitration shall be conducted in accordance with the rules of the Canadian Arbitration Association. The arbitration award shall be final and binding, and it may be confirmed and enforced in any court of competent jurisdiction. Each party shall pay for all attorney fees it incurred in connection with the arbitration and shall share equally in the costs of the arbitration. The venue for any arbitration shall be Toronto, Ontario, Canada.

Please note the extended time for prepayments (another 5-7 working days approx., because payment must be received first).

Payment by cash on delivery is not reasonable because of the excessively high administrative costs and the fact that our customers' anonymity cannot be guaranteed, and therefore is no longer possible.

We ship most orders within 7-10 business days via Global Postal Service Air Mail.

International Shipping Information:

For shipments to all countries, the following rules and restrictions apply:

• Do not order items that are illegal to import into your country. Laws are different in every country and we cannot keep up with them all. It is your responsibility to check with your Customs office to see if your country permits the shipment of our products to your country. However a seizure is very unlikely as products are being sent as an envelope via US Postal Service Air Mail.
• If the package is seized by Customs for any reason and we do not receive the package back, we will not issue you a refund. If we do receive the package back after being seized and the products are in perfect condition, we will credit you the product cost, but you are still responsible for the shipping charges.
• Prepayment is required. Payment must be by credit card or in advance.
• Shipping charges are indicated on the order form prior to sending the order.
• Important: If you write to us or order from us, but do not receive a reply back from us, then there is most likely some problem with your email address. We have received many email messages that we reply to, but - for whatever reason - the message can not make it through. We have no other way to contact you, so please make sure your email delivery is working properly and that you have given us a correct email address before complaining that we are not replying.
• You can add items to your shopping cart which displays the total and you can see the shipping charges prior to sending the order to us. We reserve the right to insure the package. You will not incur an additional charge for insurance above what is presented through the online ordering process. We believe our online order form to be accurate in computing shipping charges, but we will not be held responsible for errors in the shipping charge calculation. If we find it to be incorrect after receiving your order, we reserve the right to correct the charge and inform you by email.
• Please allow app. 2 weeks for delivery by US Postal Service Airmail. IMPORTANT: This does not include any time that your country's Customs office may hold the envelope which never happened as of yet. If you have not received your package after the allowed period, check with your postal office to track it down. There is nothing we can do to speed up this process.
• All prices are listed in US currency.
• We reserve the right to decline an order for any reason.

Any litigation, dispute, or other claim which may arise from the purchase, sale, advice, use or involvement with us shall be settled in accordance with the laws of Canada and particularly the city of Toronto, Ontario, and shall be heard and venued in that State.
